Panel Discussion on "Decoding the 9-0 Privacy Judgement"

Bangalore International Centre had organised Panel Discussion on “Decoding the 9-0 Privacy Judgement” on Friday, 10th November, 2017 at 6.30 pm. The Panelists were Mr. Anirudh Krishnan, Ms. Darshana Mitra, Mr. Harish Narasappa and Mr. Rahul Matthan. Mr. Alok Prasanna Kumar was the chair and moderator for the event.

The Supreme Court's judgement in Justice (Retd) K Puttaswamy v Union of India recognising the right to privacy as a fundamental right has implications that go far beyond Aadhaar and data protection. The panelists analysed and debated the scope and implications of the judgment from various perspectives ranging rights of excluded communities, business models for start-ups to potential impact on transparency and accountability in the judiciary.

The discussants were remarkably dispassionate in their observations and stressed that Supreme Court has been steadily expanding the constitutional scope of privacy through its judgments and pronouncements. In this process, the Supreme Court has often corrected its own judgments pronounced earlier, and even transgressed into areas untrodden earlier (e.g, BCCI judgments, Triple Talaq etc.). The discussants were unanimous that the Supreme Court must tread on this path with deliberation, caution and total transparency.
